Count Two - Joseph DeDomenico("Joe Brewster")

Count two of the indictment charges Lin with assisting Gregory Scarpa, Sr., in the murder of Joseph DeDomenico, also known as Joe Brewster, a made member of the Colombo crime family. The count charges, and the prosecutor has confirmed, that a conversation took place in the spring of 1986 in which Lin is alleged to have given information to Scarpa which caused Scarpa to have DeDomenico murdered. The murder took place on September 17, 1987, almost 18 months later.

Colombo family associates, Mario Parlagreco and William Meli, both of whom participated in the murder, previously testified in Federal trials about the murder, the reasons for the murder, and that approvals that were obtained from the hierarchy of the Colombo La Cosa Nostra family.

Carmine Sessa, a Colombo Family member who later rose to the rank of Consigliere, the number three position in the family, testified in one trial that he was told at the time by the Acting Boss and Underboss that the orders to kill DeDomenico came from incarcerated family Boss Carmine Persico, because DeDomenico had refused to commit a murder on behalf of the family and, it was feared, had "found God."

While this testimony was provided to the indicting prosecutors, they nevertheless chose to ignore it – much the same way they ignored other exculpatory evidence about other counts in the indictment.

B. At Lin's arraignment, A D A Michael Vecchione stated the following:





C. Mario Parlagreco, a Scarpa affiliated Colombo associate, previously testified in United States v. Gregory Scarpa, Jr., that he participated in the murder.

The following are key points in his testimony:

1. Greg Scarpa, Sr., and Jr. both suspected that Joseph DeDomenico, aka Joe Brewster, had been committing burglaries with individuals outside of the Scarpa Crew and not sharing the proceeds with the Scarpa's.

2. Greg Scarpa, Jr., organized the murder after getting approval from Anthony Scarpatti, a high ranking soldier in the **Colombo** crime family.

3. Greg Scarpa, Jr., admitted to Parlagreco that he shot DeDomenico in a car which was brought to Parlagreco's garage to be cleaned of fingerprints.

4. After leaving the scene of the murder, enroute to a celebration at a local restaurant, Parlagreco observed Greg Scarpa, Jr., throw a silver plated handgun into a sewer.

5. Scarpa, Jr., admonished each of the participants not to divulge their involvement in the murder because they were not made members of a family, and they therefore could be killed for participating in the murder of a made man.

D. William Meli, a Scarpa affiliated Colombo family associate who also participated in the murder of DeDomenico, provided the following information in an interview with the FBI.







E. Carmine Sessa, who was previously mentioned, testified at a federal trial in July 1995 that after DeDomenico was murdered, he (Sessa) spoke to Vic Orena, Sr., who told him that the order to kill DeDemenico ultimately came from Colombo Boss Carmine Persico. The reason given was that DeDemenico had refused to commit a murder for the family and had found "god". Portions of his testimony follow:
